Ogamba refers Lwak hijab case to TSC, warns against religious discrimination

Education Cabinet Secretary Julius Migos Ogamba has drawn a clear line on religious attire in schools, warning that institutional rules cannot be used to discriminate against learners because of their faith.
Appearing before the Senate, Ogamba confirmed that investigations into the case of Samira Ali Ramadhan, a learner at St Mary's Lwak Girls High School, established that she had been discouraged from wearing the hijab despite the Ministry of Education's policy on religious attire.
The matter has now been forwarded to the Teachers Service Commission (TSC) for appropriate action, turning what began as a dispute over school dress into a wider test of how Kenya's education system protects the constitutional rights of learners.

Ogamba told senators that the Ministry's policy position is that learners should not be discriminated against on religious grounds, and that legitimate religious practices, including appropriate attire such as the hijab, should be accommodated within schools.

The referral of the matter to TSC means the commission, which is responsible for the professional conduct and discipline of teachers, will determine what action to take against those found to have acted against the policy.

The case has drawn national attention to how schools balance discipline and uniformity with learners' religious rights, with the Ministry maintaining that dress code regulations must operate within the Constitution and national education policy.

Attention now shifts to TSC as it moves to act on the Ministry's findings in the matter.
