Kaimosi Teachers Training College has been ordered to pay a former student Sh2.5 million after a court found that his suspension was unlawful.
The court found that the former trainee's suspension violated his rights, reinforcing that colleges and other educational institutions must follow the law when exercising disciplinary powers. The ruling underscores the constitutional requirement for fair administrative action, which requires institutions to act lawfully, reasonably and through procedures that give affected persons an opportunity to be heard.

The decision has placed institutional disciplinary procedures under scrutiny, particularly the obligation of learning institutions to observe due process when taking action against students. It is likely to attract attention among teacher-training colleges and other institutions where disciplinary committees routinely handle cases involving students accused of misconduct.

Courts have previously faulted educational institutions for imposing disciplinary measures without giving students adequate notice of allegations or a meaningful opportunity to respond. The latest ruling serves as a reminder to institutions that internal disciplinary rules cannot override constitutional protections.

For Kaimosi TTC, the Sh2.5 million award represents a significant financial consequence arising from the handling of a student disciplinary matter. For students, the decision reinforces their right to challenge disciplinary decisions they believe were made unfairly or without following the law, and could serve as a reference in future disputes involving student suspensions, expulsions and other disciplinary measures in Kenya's tertiary education sector.
