Three Moi University graduates have gone to court against the Technical University of Mombasa (TUM) administration over publication of their pictures on the back of the university’s graduation booklet without their approval.
Ms Nawal Ali, Mr, Abad Elkindiy and Ms Fatima Athaman graduates of Moi University since 2019, in their petition to the High Court in Mombasa say on July 14, 2022, TUM published and distributed their pictures on its graduation booklet with a caption ‘congratulations class of 2021’ without their consent and the booklets were widely circulated within Mombasa county to advertise its graduation a thing that is against the law.
They now seeking a declaration that TUM violated their right to privacy as well as compensation for any damages or losses caused by publication of their images with no authority for commercial and financial gain.
“The petitioner’s rights have been already been trampled on by the respondent’s degrading act of publishing their graduation photo or image without their knowledge or consent,” the petition stated.
Consequently, the petitioner want a permanent order issued aimed at restraining the respondent from publishing or using their images in its advertisement or promotion in any way without their authority.
