Teaching is one of the noblest professions because it places a teacher in a unique position of trust. Parents entrust teachers with their children, expecting them to provide knowledge, guidance, discipline and protection.

Recognizing this sacred responsibility, the Teachers Service Commission (TSC) has established a comprehensive Code of Regulations that sets clear standards of professional conduct. Regulation 22 focuses on protecting learners from sexual abuse, exploitation, harassment and any conduct that compromises their safety and dignity.

The regulation begins by stating unequivocally that a teacher shall not engage in any sexual activity whatsoever with a learner, regardless of whether the learner appears to consent. This provision leaves no room for excuses or misinterpretation.

A learner cannot legally or ethically consent to a sexual relationship with a teacher because of the unequal power relationship that exists. Teachers possess authority over learners through assessment, discipline, mentorship and academic influence. Any romantic or sexual involvement is therefore considered an abuse of that authority. Period.

The regulation further prohibits teachers from making requests for sexual favours or exerting pressure on learners for sexual activity. Such pressure may be direct or subtle. It may involve promises of better grades, favourable treatment, gifts or opportunities.

It may also involve threats of punishment, humiliation, poor academic performance or disciplinary action if the learner refuses. Regardless of the form it takes, using one’s position to seek sexual favours is gross professional misconduct and a criminal offence.

Interestingly, the regulation also prohibits teachers from flirting with learners. Some educators mistakenly believe that flirting is harmless because it may not involve physical contact.

However, flirtatious remarks, suggestive jokes, inappropriate compliments, romantic messages or unnecessary physical closeness can make learners uncomfortable and create an unsafe learning environment. Professional boundaries must remain clear at all times.

Another important provision states that teachers should never send learners to their personal residences for any reason. Although a teacher may have good intentions, such situations expose both the learner and the teacher to unnecessary risks.

Professional interactions should occur within approved school environments or under officially sanctioned activities where accountability and transparency exist.

The regulation also addresses coercion and intimidation. Teachers are forbidden from inducing, threatening, or intimidating learners, particularly concerning their academic performance, in exchange for sexual relations. Academic authority must never become a weapon of manipulation. Marks, recommendations, examination opportunities and disciplinary decisions should always be based on fairness, integrity, and merit rather than personal interests.

Equally significant is the prohibition against facilitating the non-disclosure or cover-up of sexual abuse cases involving learners. Every teacher has a legal and moral obligation to report suspected or confirmed abuse through the appropriate channels.

Remaining silent, discouraging victims from reporting, destroying evidence, or protecting perpetrators amounts to complicity. Schools can only remain safe when every member of staff actively safeguards children.

Regulation 22 also protects learners during dismissal from school. Teachers should not release learners before notifying parents or guardians. Likewise, learners should not be sent away from school outside the prescribed hours except in emergencies.

These provisions recognise that schools remain responsible for learners’ safety while they are under their care. Sending learners home unexpectedly may expose them to accidents, violence, or other dangers.

The next section, Regulation 23, extends professional conduct to relationships with fellow employees and members of the public. Teachers are prohibited from sexually harassing colleagues or members of the public.

Sexual harassment includes unwelcome sexual advances, repeated requests for dates or sexual favours, inappropriate touching, offensive comments, sexually suggestive messages, or creating a hostile work environment. Respect among colleagues is essential for maintaining professionalism within educational institutions.

Persistent requests for sexual favours after rejection also constitute sexual harassment under the regulations. Consent must be voluntary and ongoing. Any conduct that continues after it has become unwelcome violates professional ethics and may attract disciplinary as well as legal consequences.

The importance of these regulations cannot be overstated. Schools should be safe spaces where learners focus on academic growth, character development and personal discovery without fear of exploitation. Every learner deserves to feel respected, protected, and valued. Similarly, teachers deserve workplaces built on mutual respect and professionalism.

Violating these regulations carries severe consequences. Depending on the nature of the offence, a teacher may face interdiction, dismissal from service, deregistration by the Teachers Service Commission, criminal prosecution, imprisonment and permanent damage to personal reputation. A single lapse in professional judgment can destroy years of dedicated service.

Teachers can protect themselves by maintaining professional boundaries at all times. Communication with learners should remain official and educational. Meetings with learners should occur in visible, accountable settings.

Teachers should avoid private conversations that could be misunderstood, refrain from unnecessary physical contact, and maintain transparency in all interactions. Social media communication should also remain professional and comply with school policies.

School administrators equally bear responsibility for creating child protection systems, conducting regular awareness training, encouraging reporting of misconduct and responding promptly to complaints.

Parents should educate their children about appropriate and inappropriate behaviour while maintaining open communication that encourages learners to report any uncomfortable experiences without fear.

Ultimately, these regulations are not intended to burden teachers but to preserve the honour of the teaching profession. The overwhelming majority of teachers are committed professionals who dedicate their lives to shaping future generations with integrity.

By adhering to the TSC Code of Conduct, teachers protect learners, safeguard their own careers, strengthen public confidence in education and uphold the dignity of one of society’s most respected professions.

Professional boundaries are not barriers to effective teaching – they are the very foundation upon which trust, safety and educational excellence are built.
