Eldoret based court has sentenced a man 30-year imprisonment for defiling and infecting niece with HIV

A 40-year-old man has been sentenced to 30 years in prison by an Eldoret court after being found guilty of defiling his 10-year-old niece and infecting her with HIV/AIDS.

The court heard that the offense occurred on unknown dates in September 2023 at Chemoru village in Uasin Gishu County.

The prosecution presented three witnesses, alongside medical evidence from Moi Teaching and Referral Hospital (MTRH), which confirmed the abuse and subsequent infection.

In delivering the judgment, Senior Principal Magistrate Daniel Sitati stated that the evidence presented was sufficient to prove the accused committed the offense beyond reasonable doubt.

The accused denied the charges, claiming he had been framed due to a land dispute with the child’s father. However, the court dismissed his defense, noting that it did not weaken the prosecution’s case.

Following the conviction, the court handed down a 30-year custodial sentence. The man was granted 14 days to file an appeal.
