The Kenya Teachers in Hardship and Arid Areas Welfare Association (KETHAWA) has moved to appeal a judgment delivered in a dispute involving teachers serving in hardship and arid areas.
The matter, registered as ELRC Petition No. E246 of 2023, involves KETHAWA as the petitioner against the Teachers Service Commission (TSC), the Ministry of Education, the Attorney General and the Ministry of Interior and National Administration.
In a Notice of Appeal, the association indicates that it is challenging the judgment delivered by the Employment and Labour Relations Court on July 29, 2026. The notice states that the intended appeal will challenge the court’s judgment on various points of law.
The notice was filed through advocate Cavin Anyuor, who represents the first respondent, while copies were served on the other parties involved in the matter.
The appeal process was further advanced on August 10, 2026, when the advocate wrote to the Deputy Registrar of the Employment and Labour Relations Court seeking certified copies of the judgment and typed proceedings.
The letter, referenced TSC/LS/001/2024, states that the judgment in the matter was delivered by Justice Jemimah Wanza Keli on July 29, 2026.
Court records sought
The advocate requested the certified court documents specifically for purposes of pursuing the appeal and indicated that the required court charges would be paid.

The dispute has now moved to the appellate stage, with the parties preparing the necessary court records for consideration by the Court.
