The driver of the ill-fated Easy Coach bus that killed one and injured 9 students of Chavakali Boys High School in an accident along the Kisumu- Kakamega highway has been arraigned and charged in Winam Law Court in Kisumu County today.
George Onyango Riako, appearing before Principal Magistrate D.K Mtai, pleaded not guilty to 10 counts, which among them include causing death of one student and injuring 9.
The court heard that on April 1, the accused was over-speeding leading to the death of one student Joseph Mwadulo.
The court was further informed that the driver deliberately applied emergency breaks, making the bus to swerve and land on its side, leading to the injuries of 9 students.
He was released on a Ksh200,000 cash bail or an alternative of Ksh500,000 bond.
In his defence, the lawyer of the accused asked the court for reasonable bond terms, saying his client was not a flight risk and would be willing to present himself before court whenever needed.
Mtai ordered the prosecution to avail witness statements to the accused lawyer and the matter to remain at rest until April 25, when it shall be mentioned and hearing date set.
A total of 23 students are yet to record their statements with the police, prompting the likelihood of the ODPP amending the charge sheet later to include their statements.
