Activists fight extension of Macharia’s tenure at TSC

In a curtained process, Teachers Service Commission has extended Nancy Macharia’s term as the commission’s CEO for another five years, a move that has been furiously opposed by activists.

In a statement given by the Midrift Human Rights network, the group asked Nakuru High Court judge Monica Mbaru to declare Macharia’s reappointment invalid citing that the position must be filled through a competitive process.

Ms.Macharia’s tenure ended on 30th June 2020 but the commission opted to extending her term in a closed door deal since the commission has failed to show any evidence that it advertised and filled the position in a competitive process.

The Midrift Human Rights cites that the TSC contravened to Article 232(g) (1) of the constitution and section 16(1) of the TSC act by failing or rather refusing to open the process of appointment. They added that Ms. Macharia’s reappointment was faced with mystery and opaqueness despite vivid constitution principles.

However, the TSC and Attorney General Kihara Kariuki are expected to file succinct responses by Monday.

In court papers, Midrift secretary general Mr. Joseph Omondi says that he verily believe that it is imperative filling a position of a secretary in accordance with the constitution. He therefore urged justice Mbaru to halt Macharia’s reappointment until the court determines its course.
