Court blocks TSC’s decision to suspend KEWOTA deductions

The Employment and Labour Relations Court (ELRC) has this morning of April 17, 2026 blocked temporarily the decision by the Teachers Service Commission (TSC) to suspend the use of check off system by the Kenya Women Teachers Association (KEWOTA) which is used for deducting dues from their members.

TSC in a letter dated yesterday April 15, 2026 to the Association’s CEO Benta Opande and signed by the Commission’s acting CEO Eveleen Mitei suspended KEWOTA check off facility following a damning media exposé that was aired in a local television station on April 12, 2026 and published in a local daily the following day.

According to court papers, KEWOTA notes that the move by TSC will paralyze its operations since the check-off system is the primary source of funds of the Association, adding that the Commission took the decision without giving them an opportunity to be heard and based its decision on unfounding claims.

“The Respondent issued the suspension letter without providing the Exparte application an opportunity to be heard contrary to the provisions of Article 47 and Article 50 of the Constitution of Kenya, 2010. That the decision is unlawful, premature, unfounded and only based on unverified media reports, rather than a concluded, transparent inquiry and or factual evidence,” read the court documents in part.

The Association stated further that the suspension will also lead to a default on financial obligations, and deny members essential services funded by these contributions, adding further that check-off facility is a statutory and contractual arrangements, and its abrupt withdrawal violates established third-party guidelines.
