The decision of President for the construction of the university at Kiabonyoru Secondary School was challenged in court by 40 petitioners who were led by West Mugirango MP Stave Mogaka.
They argued that Kiabonyoru had no good accessible roads, health facilities and enough security to provide an enabling environment for hosting students.
The petitioners through lawyer Danston Omari further accused President Willaim Ruto of hijacking Commission of University Education mandate concerning the establishment of the universities.
In his U- turn decision to withdraw the case, Mogaka said that he is a Christian and has left the case to God to charge the corrupt officials who hide behind ghost projects to squander public funds.
“I do not want history to condemn me as a person who has hindered education development in Nyamira and I will therefore withdraw the case from court,” he added.
