Reinstated Machakos KUPPET official seeks over Ksh1.5 Million in unpaid union allowances

The reinstated Machakos Kenya Post-Primary Education Teachers, (KUPPET) Vice Chairperson Yvonne Musyoka has demanded payment of her unpaid allowances totaling to over Ksh1.5Million.

Musyoka appearing before the Employment and Labour Relations Court under Justice Stella Chemtai Ruto, demanded over Kshh1.5 million in dues withheld during her nearly two-year suspension.

She told the court that she cannot afford a lawyer and decided to represent herself.

She further revealed that KUPPET is capable of paying the money as they have already spent Ksh21 million on one advocate in the desperate attempt to defend her expulsion.

“This is about fairness, justice, and accountability. I am simply asking for what is lawfully mine while the union squanders millions fighting me.” Musyoka told the court.

She also argued that withholding her allowances were punitive, aimed at frustrating her.

However, the union’s lawyer did not dispute the figures when questioned.

Justice Chemtai Ruto set the matter for mention on November, 28 2025, when further directions will be issued.

Musyoka’s reinstatement is now being viewed as a landmark victory that extends beyond her personal case, offering hope to other union officials across the country who have faced similar punitive expulsions.

The court’s declaration that the KUPPET constitution’s expulsion clause is unconstitutional has far-reaching implications, effectively protecting all officials who may have been victimized or removed from office without due process.

The move is set to benefit individuals such as William Lengoyiap and Ronald Tonui, along with others expelled by KUPPET.

The pronouncement that any expulsion clause in any union constitution is unconstitutional is now expected to reset union governance, safeguarding officials from arbitrary removal and reinforcing internal democracy within labour organisations.
