Head teachers’ association owes KRA KSh345, 180 in tax arrears

The Kenya Revenue Authority (KRA) has now written to the National Bank of Kenya (NBK) instructing the bank to recover a total of KSh345, 180.89 from the Kenya Secondary School Heads Association (KESSHA).

In a notice dated March 28, 2024 signed by Christine Macharia who is Debt Manager at the Debt Enforcement, Corporate Taxpayer Account Management Division of the Authority’s Domestic Taxes Department, KRA has directed the bank to fully recover the monies being tax dues for Pay As You Earn (PAYE).

“I hereby declare you be an agent of the above taxpayer and require you to pay me the sum of KSh345, 180.89 being tax due by the above taxpayer, from any money which may, at any time be owed by you, to the taxpayer; be held by you, or on account of the said taxpayer; be held by you on account of some other persons for payment to the said taxpayer; be held by you with authority from some other persons to pay money to the said taxpayer,” reads the notice which was addressed to the NBK Managing Director and copied to KESSHA.

“Payment should be made by you through a valid system generated payment slip. You are required to provide a return addressed to the undersigned showing any monies which may be held by you for the said taxpayer,” added the letter.

KRA has warned the bank that if it fails to comply with the notice, it will be held personally liable for the specified amount.

“Please note that in case of partial payment, this notice shall remain in force until the amount specified herein is fully recovered. Subsection 13 of Section 42 provides that, if without reasonable cause you fail to comply with this notice, you shall be personally liable for the amount specified herein,” KRA warned National Bank Managing Director in the notice.
