Court order throws KNUT elections into legal uncertainty

The Kenya National Union of Teachers (KNUT) finds itself at a critical legal crossroads following a directive issued by the Kisumu Labour Court halting its scheduled national elections set for today at Tom Mboya Labour College in Kisumu County.

In an order delivered on April 2, the court stopped the much-anticipated polls, effectively barring the union from proceeding with any election-related activities unless the directive is lifted or varied by a competent appellate court.

The decision has introduced uncertainty within the teachers’ union, with legal experts warning of far-reaching consequences should the leadership defy the order.

According to legal counsel, the court’s directive is binding immediately and must be respected in full.

Any attempt to conduct the elections in defiance of the ruling would amount to contempt of court — a serious offense that could attract penalties including fines, imprisonment, or even disqualification from holding office.

Further, lawyers caution that elections conducted against a subsisting court order would be considered null and void from the outset.

In such a scenario, the Registrar of Trade Unions would be legally barred from recognizing or registering the outcome, rendering the entire exercise invalid.

Beyond institutional implications, individual officials who authorize or participate in the elections risk personal liability.

They could be cited in contempt proceedings and ordered to bear legal costs or face other sanctions imposed by the court.

Observers note that proceeding with the elections despite judicial intervention could also dent KNUT’s reputation and undermine its standing as a law-abiding national union.

Legal advisers now recommend that the union immediately suspend all election activities pending further court directions, emphasizing that compliance with the rule of law remains the safest path to safeguarding both the union’s integrity and its leadership.
