The Employment and Labour Relations Court (ELRC) in Meru has ordered Kenya Union of Post Primary Education Teachers (KUPPET) to pay its three branch Executive Secretaries their two months’ salary arrears.

In the court order dated today April 11, 2024,  Justice Onesmus Makau has ordered KUPPET to pay William Lengoyiap of Samburu, Kimwere Moses  of Isiolo, and Peter Omondi Oluoch of Tana River their February and March 2024 salaries which are now overdue, pending the determination of their case.

“The 2nd Respondent (KUPPET) is directed to pay the applicants (Lengoyiap, Kimwere, and Oluoch) their salaries as and when they fall due including February and March 2024 which are overdue. This Order of payment of salaries shall remain in force until the determination of the suit,” ordered Justice Makau.

On February 1, 2024, the court suspended the decision of the Teachers Service Commission (TSC) of posting the three branch bosses to class under unclear circumstances, ordering KUPPET to continue paying their salaries and allowances pending the hearing and determination of the case.

The three moved to court on January 29, 2024 to sue TSC, KUPPET, TSC CEO Dr Nancy Macharia, and KUPPET Secretary General Akello Misori over their recent move of plucking and posting them in class, in what was seen as bitter leadership wrangles in the union.

In their posting letters dated January 23, 2024 Oluoch was asked to report to Uriri High School to teach Mathematics and Physics, Lengoyiap was posted to Kirisia Secondary School and later on to Samburu Mixed Secondary School to teach Biology and Agriculture, while Kimwere was taken to Waso Secondary School to teach Mathematics and Chemistry.

Judgment of the case shall be on June 7, 2024.
