A Migori court has ordered a learning institution to pay trader Sh1.5 million for items delivered to them after it was found out that the school failed to honor its contractual obligations.
The Rongo Principal Magistrate R. K. Lagat declared that the defendant namely, the management of Kodero-Bara Secondary School breached contractual agreement and should pay the plaintiff outstanding balance for goods supplied to the defendant while the cost of the suit was awarded to the plaintiff and that all shall attract interests at court rates from the date of judgment until payment is settled in full.
The school will therefore pay the businessman who supplied goods to the school as per contractual agreement signed and was produced in court by the supplier’s lawyer.
The supplier through his lawyer Fred Onyango Okanga filed petition in court to have the school compelled to honor contractual agreement and pay for the goods he delivered to the management in the year 2021.
The court having listened to the plaintiff’s argument in court ruled that the school should honor the agreements.
The defendant failed to file statements of defense and interlocutory judgment was duly entered against the defendant
The plaintiff testified and produced statement filed in court as evidence and LPO dated7/1/2021 requesting him to supply various goods to the school as exhibit 1.
The plaintiff also produced various bank cheques that were issued and cancelled as exhibit 2 to 9 and various invoices as exhibits 10-13 as the court responded to prayers sought by plaintiff.
