The Employment and Labour Relations Court in Mombasa has issued a temporary order stopping the recruitment process for the Chief Executive Officer (CEO) position at the Teachers Service Commission (TSC).
This decision follows a petition filed by a lawyer alleging that the recruitment process violates constitutional provisions.
Justice Ocharo Kebira granted interim orders on Monday evening following an urgent application by Mombasa resident Thomas Mosomi Oyugi, who challenged the recruitment process, citing constitutional violations and discriminatory practices.

“The status quo that shall be obtained on May 27, 2025, at 5:10 PM, as regards the impugned process, shall be maintained till further orders of this court,” stated Justice Kebira.
This development comes as the TSC CEO, Dr Nancy Macharia, approaches the end of her term, set to conclude on June 30, 2025.
The TSC initiated recruitment to identify a successor and invite applications from qualified candidates.
Further proceedings will determine the validity of the petitioner’s claims and the future course of the TSC CEO recruitment.
