Senate invites public views on Basic Education (Amendment) Bill, 2023

The Senate of Kenya has called on members of the public to submit their views on the Basic Education (Amendment) Bill, 2023, as part of the constitutional requirement for public participation in legislative processes.

The Bill, formally known as National Assembly Bills No. 59 of 2023, was read for the First Time in the Senate on February 12, 2026, and subsequently committed to the Standing Committee on Education for consideration.

In accordance with Article 118 of the Constitution, the Committee is required to facilitate public involvement and take into account the views and recommendations of citizens before tabling its report to the House.

The proposed amendments seek to revise the Basic Education Act, 2023 by deleting the provision that mandates the County Education Board to appoint Sub-county Education Boards.

In its place, the Bill proposes the establishment of Sub-county Education Boards under a new framework and further requires that these boards consult County Education Boards in the execution of their duties.

To allow stakeholders to present their views, the Committee will hold a public hearing on Tuesday, March 3, 2026, at 10:00 a.m. at the Mini Chamber, First Floor, County Hall Building in Nairobi. Members of the public are welcome to attend and make oral submissions.

In addition, written memoranda may be hand-delivered to the Office of the Clerk of the Senate at the Main Parliament Buildings in Nairobi or submitted via email to clerk.senate@parliament.go.ke, with a copy to educationcommittee.senate@parliament.go.ke.

All submissions must be received on or before Thursday, March 5, 2026, at 5:00 p.m.

The Senate has emphasized that public input will play a critical role in shaping the final recommendations of the Committee.

Education stakeholders, including teachers, school administrators, parents and civil society groups, are encouraged to participate actively in the process to help influence the direction of education reforms in the country.
