Kimathi Primary School students and administration in Kamukunji Constituency in Nairobi County are facing eviction over tussle of the piece of land on which the school is built.
A private developer has given an evacuation notice to the school to pave way for construction of a shopping mall and community halls saying the school was illegally occupying the land.
However, education stakeholders and parents led by Bahati MCA Patrick Macharia have refuted the issuance of the notice as they argued that the land legally belongs to the school.
Macharia said the cartel had put unofficial notice board at the gate of the school but he managed to demolish it.
He said the man has been claiming the land but it belongs to the Nairobi County government.
“I went there and we demolished the notice he had put at the gate.
You cannot come here and put a fake notice in a school. That is unacceptable,” Macharia said.
At the same time, he said that it is due time they move to court and arrest the culprit whose main aim is to deny children their fundamental right to education which is protected by the Constitution of Kenya for the safety of the students and teachers.
“We shall not allow land grabbing especially belonging to schools. We are working to revoke the title deeds given illegally. The school was given the land by the County government,” Macharia said.
Buruburu Sub-County Police Commander Francis Kamau confirming the incident said they are looking into the matter to ensure justice is served.
”We are doing more investigations into the matter to find out who the rightful owner of the property is,” Kamau said.
The school was established by the City Council in 1975 and has been run by the county government for many years.
