Lawmakers call out principals for disregarding law on ethnic balance in staff

Committee on PIC Education and Governance Chair Jack Wamboka (Bumula MP). The committee wants schools to observe ethnic balance in recruiting staff.

Lawmakers have called on education institutions to adhere to the provision of the National Cohesion and Integration Act regarding ethnic consideration during recruitment.

Committee on PIC Education and Governance led by Jack Wamboka (Bumula MP)  said this during a session  to review the summary of the Reports of the Auditor-General on the financial statements of various institutions for financial years 2018- 2021.

The reports unveiled a number of loopholes ranging from non-compliance with the law on ethnic composition, non-compliance with consolidation procedures, fraudulent fee payment entries, officers in acting capacity for more than the stipulated time of 6 months, pending bills, and unremitted pension and other statutory deductions.

Others are in regards to inaccuracies in financial statements and lack of internal audit departments and audit committees, among others.

Navakholo TVC faced an audit query regarding non-compliance with law on ethnic composition.

According the documents tabled before the committee during the period under review, the college had 40 employees, 36 out of whom were from the same ethnic community contrary to section 7(1) and (2) of the National Cohesion and Integration Act.

The institutions had also neither established an internal audit function nor an audit committee board.

Further review of the staff establishment records revealed that Bureti TTI with a staff total of 89 is 100 per cent one community, which is against the National Cohesion and Integration Commission Act, 2008.

The lawmakers put on notice principals and heads of institutions over non-compliance with the law on ethnic composition.

The members noted that efforts need to be made to ensure public institutions have the face of Kenya in their composition.

The committee also deferred review of the financial reports of several institutions until a meeting with KUCCPS is set.
