KUPPET senior officials sent back to class by TSC win landmark case

Kenya Union of Post Primary Education Teachers (KUPPET) executive secretaries who were sent back to class for opposing unauthorized constitutional amendments have won their case.

In a meticulously researched judgment at the Nyeri Labour Relations Court, Presiding Judge Onesmus Makau strongly upheld the rights of the affected officials, specifically William Lengoyiap of Samburu, Moses Kimwere of Isiolo, and Omondi Oluoch of Tana River.

The case of Omondi, who was sent to teach in Migori hundreds of kilometres away from his work station, particularly caught the judge’s attention due to its punitive and discriminatory nature.

According to Laikipia County KUPPET Executive Secretary Robert Miano, the court overturned the decision to send the officials back to class because they have clear terms of service of five years and can only be redeployed if they fail to be re-elected.

The court found that sending only Lengonyiap, Omondi and Kimwere to class was highly discriminatory.

The court also directed that the officials are paid their salaries and allowances as long as they are in office.

According to the court ruling, the Teachers Service Commission (TSC) and KUPPET are to bear the costs of the case, as they were responsible for the petition.
