KUPPET Busia branch demands refund of housing levy deducted

Kenya Union of Post Primary Education Teachers (KUPPET) Busia branch has called on Teachers Service Commission (TSC) to comply with court orders and refund the housing levy which was deducted from teachers’ salaries since its implementation.

KUPPET Busia Executive Secretary Moffats Okisai said that it is immoral and illegal for the TSC to disobey court rulings and deduct housing levy from teachers bleeding payslips, hence demanding for a refund of the money as a show of compliance to the law.

“As a constitutional commission, TSC has not only a legal, but a moral responsibility to obey just laws and rulings. Conversely, teachers have a moral and legal responsibility to disobey and disregard unjust laws and practices,” said Okisai.

The controversial Housing Levy was declared unconstitutional by the High Court in its November 28, 2023 ruling with the Court of Appeal on January 26, 2024 dismissing the application for the stay of execution and declining to grant conservatory orders in relation to the impugned section 84 of the Finance Act 2023.

Last week, the union top leadership gave the Commission 14 day’s ultimatum to refund the housing levy or face legal action terming the deductions as blatant disobedience of court orders by TSC.
