Kenya School of Law may be devolved to counties if Bill passes

There is a possibility that Kenya School of Law (KSL) will be devolved to all counties if Embakasi East MP Paul Ongili’s Draft Bill is passed into law.

Ongili, popularly known as Babu Owino, wants the Karen-based school decongested by taking the functions to the grassroots.

The Legal Education (Amendment) Bill, 2023 was presented to the Justice and Legal Affairs Committee (JLAC) that is chaired by George Gitonga Murugara (Tharaka) for consideration.

It seeks to amend Section 8 of the Legal Education Act, 2012 in order to confer upon the Council of Legal Education (CLE) the power to accredit legal education providers in order to allow other institutions to offer the programme.

Babu said the number of universities offering Bachelor of Laws Degrees in Kenya has sharply increased over the years, and there is need to devolve it so that other institutions can offer the Advocates Training Programme.

“There is strain for the current Kenya School of Law facility in terms of resources and we also need to reduce the student-teacher ratio as the quality of training gets compromised,” he argued.

Further, amendment of the Act will require CLE to prescribe, through regulation, the admission requirements for persons seeking to enroll in all legal education programmes.

“This has been inspired by the conflict happening between the KSL Act and the CLE Act. There are some students who are being discriminated to join KSL based on the grade that they scored in high school,” Stated Babu.

Murugara affirmed that opening up the CLE Act will enable more institutions to offer legal education programmes.
