Kangaroo Courts hindering child justice in Elgeyo Marakwet, Magistrate reveals

Senior Principal Magistrate Gladys Adhiambo has raised concern over Kangaroo courts, saying that they have become a major obstacle to children accessing justice in Elgeyo Marakwet County.

Adhiambo said all matters involving children must be formally taken to court, noting that resolving such issues through informal community forums is unlawful.

“Children matters should be taken to court. Solving such matters outside the court process is against the law, and anyone found engaging in kangaroo courts will face stern action,” she said.

Speaking to the press at the Iten Law Courts, the magistrate further urged all stakeholders in the justice system to ensure the timely provision of documents, reports, and witnesses to expedite children’s cases during Child Justice Month.

She noted that although the courts aim to conclude children’s matters within six months, special efforts are underway to clear all pending cases by the end of this month.

“We are calling on advocates to attend court when required, police officers to avail files and witnesses, and children and probation officers to ensure reports reach the court on time,” she said.

Adhiambo also reminded parents that both fathers and mothers—whether married or not—have equal responsibility in caring for their children. She encouraged anyone with a child-related case to file it formally in court.

“Our officers have set up a special desk to assist anyone facing challenges in filing such cases,” she said.

The magistrate also emphasized that access to justice is no longer limited by distance, as the court now conducts virtual hearings, enabling individuals from any location to participate in proceedings.
