Head teacher jailed over failure to pay debt

A head teacher from a primary school in Masinga Sub-county, Machakos has been jailed for six months due to failure to pay a debt that she had acquired in June 2019.

The Kwa Kaindi Primary School head teacher, Petronillah Ndinda Kaloki, was on Wednesday committed to civil jail by the Small Claims Court in Machakos after failing to pay Sh. 65,812 which she had borrowed from one Mr. Richard Mulwa.

Ms. Kaloki was sent to serve in Machakos Women’s Prison after failing to convince the court about her inability to pay the said amount.

The claimant Mr. Mulwa sued her last year and Kaloki lost the case on November 14 in one of the swiftest cases dispensed by the Small Claims Court which was recently commissioned to deal with such issues.

Ms. Kaloki who was representing herself in the case had earlier made an application under a certificate of urgency to have her case reviewed but the judge dismissed the application.

She had argued that unless her application was granted before the expiry of the stay period she was bound to suffer irreparable loss and damage.

The accused was brought before the court under a warrant of arrest before sentencing.

The said amount including penalties had accrued to Sh. 82,812 by the time of committal to civil jail.

The case is perhaps a tip of the hard economic times that Kenyans are facing with many unable to service loans from shylocks and other creditors.
