The Milimani Chief Magistrates Court has issued an interim order directing Kakamega-based blogger Simon Asiviela to publicly apologize to Lugari MP Nabii Daraja Nabwera over defamatory social media posts that falsely implicated him in the death and disappearance of Munyuki High School Principal Simon Isiaho Shange.
The posts, published on platforms including Kakamega Post, Malava Online, and Lugari Watchdog, falsely accused the MP of being involved in the principal’s disappearance and death.
The court ruling, delivered after an urgent application from MP Nabwera’s lawyer, Danstan Omari, stated that Asiviela’s publications were “malicious, false, and unqualified.”

Nabwera, in his affidavit, argued that the posts were baseless and politically motivated. He further explained that the defamatory content had stirred public unrest, with threats against his home and family, undermining his reputation and safety.
The MP’s legal team sought urgent conservatory orders to prevent further harm and demanded Ksh. 20 million in compensation for reputational damage.
The court, after considering the severity of the matter, granted Nabwera’s request for a public apology from Asiviela.
The apology is to be issued as part of a wider effort to halt the spread of defamatory publications, which have placed unnecessary pressure on the MP.
