Court frees baby Sagini’s grandmother, cites insufficient evidence

The Kisii High Court has acquitted baby Sagini’s grandmother, Rael Nyakerario, saying that the prosecution failed to prove the case beyond reasonable doubt to have her serve five years in prison.

The decision comes after her Lawyer, Okerosi Ondieki, filed a notice of appeal to have the case reviewed.

Nyakerario had been arrested along with Pacificah Nyakerario and Alex Ochogo and charged with grievous harm for gouging out baby Sagini’s eyes on December 14, 2022.

In his judgment, Justice Waweru Kiarie further wrote that one of the witnesses faced challenges in providing credible and sufficient evidence against the accused person.

The Court also found out that the evidence provided by this witness did not corroborate with other witnesses.

Justice Kiarie pointed out that the prosecution failed to bring a sign interpreter to relay what the prosecution witness was saying.

He also said that the investigators did not carry out their investigations well enough to prove to the Court that the appellant participated in gouging out baby Sagini’s eyes.

Lawyer Ondieki celebrated her release, saying that justice had been served and Nyakerario was going home to take care of her grandchildren.

While addressing the press, Ondieki asked members of the public to be accommodative and receive Nyakerario back into the community as she had been proven innocent.

Nyakerario attributed her release to prayer and thanked God for listening to her cries.
