Moi University Students sue University over graduation list

Moi University students who missed in 22nd August graduation list have filed a petition seeking to be included in graduation ceremony on Thursday next week.

The 13 students are among 700 others who are protesting their exclusion from the list. They want the court to stop the graduation if their names are not included.

The students, who had enrolled in the university between 2015 and 2016, accuse the University of discriminating them, they say some of their colleagues who were in the same class were listed in the list but the university has failed to give an explanation why they were left out.

In their petition they said a lecturer who had failed to release their marks after the university failing to pay him, had released the marks after intervention by the Ministry of Education.

After the release of the marks they were updated in the university portal but the university selected few to graduate leaving them out.

The affected students were supposed to graduate on December last year but the graduation was pushed to August 2019 due to the lecturers strikes. Their students’ cards expired in December 2018.

The petitioners contend that the respondent has breached their constitutional rights to; Discriminating them contrary to article 27,fair administration action contrary to article 47 of the constitution , dignity contrary to article 28 of the constitution, and psychological torture contrary to Article 29(d),” part of the  petition read.

They indicated that they are likely to not get promoted, job opportunities, scholarships, continued psychological torture and loss of money.

The court through Justice John Mativo issued an order for the suit papers to be served to the institution administration and the parties to appear in court Friday 16th August 2019. The orders were served in Nairobi Campus and in the main campus.
