- TSC has re-advertised the position of Secretary and CEO after the High Court nullified the 2025 recruitment over procedural flaws.
- The court has found that the earlier advert breached the 14-day minimum period and failed to disclose salary and benefits.
The Teachers Service Commission (TSC) has re-advertised the position of Secretary and Chief Executive Officer following a High Court decision that nullified an earlier recruitment process over procedural irregularities.
In an advertisement dated September 29, 2026, the commission invited qualified Kenyans to apply for the position. Applications will close on Friday, October 30, 2026, at 5pm.
The fresh recruitment follows a judgment delivered by High Court Judge Francis Nyungu Kyambia on September 17, 2026, which quashed the recruitment process arising from an advertisement published by TSC on May 6, 2025.
The court found that the 2025 advertisement gave prospective applicants only 13 days to submit their applications, contrary to the commission’s Human Resource Policies and Procedures Manual, which requires a minimum application period of 14 days.
Justice Kyambia also faulted the advertisement for failing to disclose the salary and benefits attached to the position. The court found that the omission breached transparency requirements under Article 47 of the Constitution and the commission’s own guidelines on fair administrative action.
The judge directed TSC to re-advertise the position and conduct a fresh recruitment process in accordance with the Constitution, its internal policies and the principles of fair administrative action. The court did not impose a specific timeline for the fresh recruitment or direct the commission to appoint a particular candidate, allowing TSC to restart the process within its administrative mandate.

The court, however, upheld the statutory requirement that applicants for the position must hold a degree in education and have at least 10 years’ experience in the education sector.
Under the new advertisement, the Secretary will head the TSC secretariat and serve as the commission’s Chief Executive Officer and Accounting Officer. The office holder will be responsible for overseeing the implementation of the commission’s policies, decisions and mandate.
Applicants must be Kenyan citizens, hold a degree in education from a recognised university and have at least 10 years’ experience in education, administration, management, public administration, human resource or financial management. They must also satisfy the requirements of Chapter Six of the Constitution.
The successful candidate will serve a five-year term, renewable once. The position carries a gross monthly salary of Sh698,600, an airtime allowance of Sh15,000 per month and an annual leave allowance of Sh50,000. The office holder will also be provided with an official vehicle with an engine capacity not exceeding 3,000cc.
TSC will provide annual medical cover for the successful candidate, one spouse and up to four fully dependent children below the age of 25. The package provides inpatient cover of Sh10 million, outpatient cover of Sh300,000, maternity cover of Sh150,000, dental cover of Sh75,000 and optical cover of Sh75,000.
The CEO will also receive a service gratuity equivalent to 31 per cent of annual pensionable emoluments for the term served. Other benefits include group life insurance and group personal accident cover, each equivalent to three times the annual pensionable emoluments.
The commission will provide a car loan of up to Sh6 million and a mortgage facility of up to Sh30 million. The facilities will attract an interest rate of three per cent per annum, with the mortgage repayable over a maximum period of 20 years and the car loan over a maximum of five years.
According to TSC, the mortgage and car loan schemes will be administered and managed centrally by the National Treasury under existing regulations and will be subject to the availability of funds.
The successful candidate will also receive security as advised by the Inspector General of Police. TSC said the security provision will not be converted into cash. The CEO will further be entitled to a daily subsistence allowance for local and foreign travel at rates reviewed and set by the Salaries and Remuneration Commission from time to time.
Applicants have been directed to download and complete the TSC application form and submit it together with a detailed curriculum vitae, certified copies of their national identity card or passport, relevant academic and professional certificates and testimonials. The application form will also be available electronically through the TSC recruitment portal.
Applications may be submitted online through the recruitment portal, by email in PDF format to chairperson2026@tsc.go.ke, or by hand during official working hours. Hand-delivered applications should be placed in a sealed envelope clearly marked “Application for the post of Secretary/Chief Executive Officer” and delivered to the office of the Commission Chairman at TSC House, 3rd Floor, Tower Wing, Kilimanjaro Road, Upper Hill, Nairobi.

Applicants are also required to submit clearance certificates from the Kenya Revenue Authority, Higher Education Loans Board, Ethics and Anti-Corruption Commission, Directorate of Criminal Investigations and a recognised Credit Reference Bureau.
TSC said the names of all applicants and the interview schedule for shortlisted candidates will be published in the print media and on the commission’s website after the closure of the advertisement and completion of the shortlisting process.
Only shortlisted candidates will be contacted for interviews, while canvassing in any form will lead to automatic disqualification.
Evaleen Mitei is currently serving as the acting CEO of the commission following the departure of Dr Nancy Macharia.
