The Employment and Labour Relations Court in Nairobi has temporarily suspended the secondary school teachers’ strike organized by the Kenya Union of Post-Primary Education Teachers (KUPPET) until September 5.
The Labour Court issued the order on Tuesday, August 27, following an urgent application filed by the Teachers Service Commission (TSC) on Monday, August 26.
Justice James Rika stated that the orders will remain in effect unless altered during the court’s mention of the matter on September 5.
“Pending hearing and determination of the Application inter partes, an order of temporary injunction is granted to the Petitioner, restraining the Respondent, its officials, members, employees, agents, or other person acting on its behalf, from withdrawing labour and/or commencing, engaging in, participating or continuing to participate in the intended industrial action, set to commence or 24th August 2024, or any other time thereafter,” the judge declared.
The court directed TSC to serve the Respondent and Interested Party, who will then have seven days to submit their respective responses.

TSC took legal action after teachers affiliated with KUPPET in certain regions of the country began a nationwide strike on Monday, citing unresolved issues.
KUPPET remained firm, stating that the union will continue with the strike until the government addresses its demands.
The union continued to push for the strike even as the Kenya National Union of Teachers (KNUT) agreed to the government’s request for more time to address the demands.
KNUT instructed teachers to report to work for the third term, withdrawing its strike notice just hours after KUPPET voted to proceed with the strike.
